General Pardon Law (Law No. 17)

The President of the Republic, in accordance with the constitution and what the People's Assembly approved at its session held on 24/8/1421 AH (corresponding to 21/11/2000), has issued the following:

Article 1: A general pardon is granted for the crimes committed before 16th November 2000, as follows:

A) For all punishment for crime specified in Article 10 of Law 49 for 1974 (amended).

B) For all punishment for misdemeanours.

C) For all punishment for perpetrators of the crimes of internal desertion specified in Article 100 of the Military Penal Code. Deserters who are in hiding are not covered by the regulations of this paragraph unless they surrender themselves within 60 days from the issuance of this law.

D) For all punishment for infractions specified in Articles 57, 60 and 70 of the Military Conscription Law issued by Legislative Decree 115 on 5th October 1953 (amended) and for other infractions punishable under other regulations.

E) For reform and care measures for juveniles who committed misdemeanours.

F) For all punishment for perpetrators of crimes of smuggling specified in Legislative Decree 13 dated 15th February 1974 (amended), with the exception of crimes of drugs smuggling and crimes of resisting the authorities with the force of arms.

G) For all punishment for perpetrators of crimes specified in Legislative Decree 24 dated 31st August 1986 (amended), Legislative Decree 6 dated 22nd April 2000 and Articles 15, 23 and 24 of the Economic Penal Code issued by Legislative Decree 37 dated 16th May 1966 (amended).

H) For one-third of the punishment for other felonies specified in the Economic Penal Code.

Article 2: Excepted from this law are:

A) Crimes specified in Law No 10 of the year 1961.

B) The misdemeanours specified in Articles 345 to 349, Articles 351 to 356, Articles 358 to 362, Articles 365 to 367, Articles 397 to 405, Article 428, Article 435, Article 441, Articles 450 to 461, Article 476, Article 500, Article 504, Article 505, Articles 507 to 527, Articles 628 to 632, Article 635, Article 636, Articles 641 to 644, Article 652, Article 653, Articles 656 to 659 of the General Penal Code; and Articles 112, 113, 120, 133, 135, 140 and 149 of the Military Penal code issued by Legislative Decree No 61 of the year 1950 (amended).

C) The fines imposed on violations of the customs laws and regulations, spare parts, cigarettes and tobacco, stamps and building regulations and other laws, the fines of which carry the character of civil compensation to the state or public quarters.

D) The exceptions in Paragraph B, Article 2, do not include the misdemeanour punishments against debtors or those convicted under Article 5 of Law No 2 dated 3rd April 2000. These people benefit from pardon regulations in paragraph B of Article 1 of this law.

Article 3: This pardon does not cover people hiding for felonies which are punishable under this law unless they surrender to the competent authorities within three months from the date of the issuance of this law.

Article 4:

A) This pardon does not cover the fines for crimes specified in Paragraphs F and G of Article 1 of this law. It also does not cover sequestration measures and decisions.

B) Fees and fines for crimes are not reimbursed if they have been paid to the Treasury.

Article 5: This pardon has no effect on personal litigation suits. A court concerned with public right examines these suits. A person must file his suit before this court within a year. He loses his right to file this suit before a criminal court after a year but he can file it before a civilian court.

Article 6: This law shall be published in the official gazette and shall be effective from the date of its issuance.
